  • If a person was arrested, but the criminal charges were, for example, dismissed by the Mifflin County Court, or withdrawn by the Mifflin County District Attorney's Office, these charges may be eligible for expungement; charges that were dismissed or withdrawn may, depending on the circumstances of the case, be instead eligible for a "partial" expungement, also known as a "redaction."

While well-circulated popular myth may cause people to believe that these records are only temporary, the truth is that they will continue to exist even after a person's 18th birthday has passed. Pennsylvania presents petitioners with a wider array of avenues under which a person may expunge their records:

  • A person that is over the age of 18 may request an expungement at any time, however, the court must approve of the reasoning behind their request.
  • A person that was convicted of a juvenile offense may be eligible once they have fulfilled their sentence and completed a five (5) year waiting period without additional criminal matters.
  • A person that has completed a court-ordered supervision will be eligible for an expungement once at least six (6) months have passed without additional criminal proceedings.
  • A person that was arrested on a juvenile charge, but had the charges dismissed, will be eligible for an expungement provided they do not have any other pending criminal matters.

If a person has more serious misdemeanor records, they may be able to seal them under Pennsylvania's "Limited Access" laws. These laws prevent background check agencies from accessing records. This effectively seals the records and prevents these records from interfering with a person's goals. Under state law, only 2nd degree, 3rd degree, and ungraded misdemeanor charges may be sealed. In addition, a person must also have completed a waiting period of ten (10) years without further or additional criminal matters against them.
