Drugged Driving vs. Drunk Driving in Bucks County

There are some important differences in how a drugged driving charge will be handled versus a drunk driving charge. Drugged driving charges are handled through a "per se" style limit, where if a certain level of metabolites of a drug is in your blood at the time you are driving, you can be charged with DUI even without other proof that you were intoxicated. Because of how drug metabolites stay in the blood for a long period of time, you may have ingested the drugs days ago, and still be charged (especially with marijuana).

Penalty Differences

The primary difference has to do with the penalty levels. In DUI sentencing, there are 3 "tiers." A typical first time drunk driving DUI with a relatively low-level BAC will be in the first tier, subject to the following penalties:

  • Up to six months of probation
  • $300 fine
  • Alcohol highway safety school
  • Drug or alcohol treatment (if ordered)

However, drugged driving charges are automatically put into the third tier, even when it is a first-time offense for a DUI. As a result, a first-time drugged DUI carries the following penalties:

• Imprisonment up to 6 months and a misdemeanor conviction
• Minimum $1,000 fine; maximum of $5,000
• One year driver's license suspension
• Attend an alcohol highway safety school
• Drug & Alcohol assessment and compliance with all drug and alcohol treatment requirements
